The Gorham Mfg. Co. Sues to Protect a Patented Mold

The Gorham Mfg. Co. has brought suit in the United States Circuit Court at New York against Graff, Washbourne & Dunn, 142 W. 14th St., New York, for the alleged infringement of a mold for casting metals. The complainants declare that the mold was invented by Eugene C. Smith, Providence, R. I., Dec. 31, 1892, and that the United States Patent Bureau at Washington issued a patent to Mr. Smith for the exclusive right to use the mold, Jan. 16, 1894, for a term of 17 years ; that Mr. Smith in turn transferred the exclusive license to the Gorham Mfg. Co., which concern now controls it. and that Graff, Washbourne & Dunn have been, and are still, using the mold to their profit, and despite frequent requests to cease the alleged infringement, they have continued and are making large profits thereby.

The complainants ask for an accounting of the profits made by the defendants by the alleged infringement, for a temporary and permanent injunction restraining them from using the mold, for a penalty equal to three times the actual profits made by the defendants and the damage done to the complainants for wilful and unjust infringement and for the costs of the suit.

The answer of the defendants to the complaint has not yet been filed.

The Gorham Manufacturing Company has leased the store at Fifth Avenue and Twenty-sixth Street. It will be used as a branch retail establishment during the holiday season.

The three travelers from the Chicago branch of the Gorham Manufacturing Co., H. S. Willis, W. H. Burton and T. G. Jewett, returned last week from a short stay in the East, visiting the factory and going over new designs In preparation for their fall trips. They leave next week for their regular territories.

Saturday the employes of the architectural department of the Gorham Mfg. Co gathered to say farewell to John Waldie, who is to take a position in New York. Brief remarks were made by J. Sutherland and others, after which, as a token of good will, a gold and silver fountain pen was presented to Mr. Waldie.

Walter Ghislin, of the Gorham Manufacturing Co., and Harry Ghislin, of Hyman, Berg & Co., returned the early part of the month from their summer outing which was delightfully spent up among the Wisconsin resorts.

PROVIDENCE

The grand jury has returned an indictment against Robert E. Byrnes. of this city, for receiving on Aug. 10th 47 ounces of scrap silver of the value of $29.14, the property of the Gorham Mfg. Co., knowing it to have been stolen from them.

W. S. Edward, a veteran employe of the Gorham Mfg. Co., with whom he began work in 1871, and his wife celebrated their golden wedding anniversary last Monday evening, at their home in Auburn.

William H. Crins, who formerly was president of the Gorham Mfg. Co., died recently at his home on Linden Street, Providence, R. I. His connection with the Gorham Company did not terminate, however, with the relinquishment of its presidency, for he was one of its directors up to the time of his death. He was born in Newport, in 1819, and after receiving his education went to earn a livelihood. He was in the painting business for thirty years, and in 1879 was elected president and a director of the Gorham Mfg. Co., upon the death of John Gorham. In 1894 he resigned from the presidential office and was succeeded by Edward Holbrook. As a mark of appreciation of his services to the company the directorate expressed a wish that he continue as one of its members, and he did so.

Manager Prentiss of the Gorham Mfg. Co. returned Jan. 16 from New York in response to a telegram from Mrs. Prentiss announcing the serious illness of her sister.

About 35 employes of room M-5 of the Gorham Mfg. Co. held their fifth annual outing last week Saturday at the residence of A. F. Hughes, on Reservoir Ave., this city. Sports and a clambake were the principal attractions. Soon after the arrival of the party at the Hughes home it was served with chowder, following which quoits, races and a number of games were enjoyed until 4 P. M., when the bake was served. After dinner there was a musical programme and several addresses were made.

The Gorham Mfg. Co., issued notices the past week, signed by Alfred K. Potter, treasurer, announcing that it will redeem on Feb. 1, 1920, the following bonds to the aggregate of $750,000 which is a portion of the 3,000,000 first mortgage 7 per cent serial gold bonds which the corporation issued on Feb. 1, 1918. These bonds for which the call for redemption is issued are as follows: Bonds No. M-751 to M-1000 maturing Aug. 1, 1920; Bonds No. M-1001 to M-1250, maturing Feb. 1, 1921, and Bonds No. M-1251 to 1500, maturing Aug. 1, 1921. The bonds thus called for are redeemed at this time under the provision of the trust mortgage which provided for their redemption previous to the maturing date at the option of the corporation. Interest on the bonds ceases on the day of call, the last day of January, 1920, as February 1, 1920, falls on Sunday. Payment of the bonds will be made to the amount of 102 per cent of the principal, with interest to the first day of Feb., 1920. It is understood that nearly two-thirds of these bonds are held locally.
