Messrs. Porter Bros., jewellers, Birmingham, summoned William Flavel and Thomas Flavel, trading as Flavel & Son, jewellers, of Unett Street, Birmingham, for that they did apply a certain registered design for the ornamentation of earrings to certain earrings of the defendant's manufacture, and thereby infringe their copyright to such design. The ornamentation consisted of a combination of a fluted crescent fixed upon a disc, and it was proved that the defendant manufactured a similar design on certain earrings in September last. For the defence Mr. Dursett called witnesses to show that the combination had been in use three years before the registration by complainants, and also submitted that the design was not a new and original design within the meaning of the act.—The summons was dismissed.

CALAB LAWDEN MOORE

Mr. Calab Lawden Moore, a Birmingham manufacturing jeweller, now aged 86, was the subject of a BBC Home Service programme, "People Today," on 12th April. Mr. Moore's great interest has always been precious stones, especially diamonds, and he is considered to be one of the accepted experts on the subject. He still commences work at 7.30 each morning and mantains the rigid discipline as regards hours that he did when he first started at the age of 13. Mr. Moore's company in Hylton Street, Birmingham, specialises in diamond and gem set jewellery.

DEATH OF NOTED SPORTSMAN - MR. OLIVER HOWARD VAUGHTON - ASTON VILLA VETERAN

The death is announced of Mr. Oliver Howard Vaughton, well-known Midland sportsman and a former President of Aston Villa Football Club. Mr. Vaughton had been in ill-health for two or three years, and his death followed an operation. His home was at 23, Oxford-road, Moseley.

In his younger days Mr. Vaughton was well-known as an international footballer, a skater who achieved national fame, a cricketer of county class, and a successful racing track cyclist. He also gained a name at running, boxing, swimming, hockey and as a gymnast. Mr. Vaughton, who was 76 years of age, played football as a youth of 14 for the Waterloo Football Club and joined Aston Villa Club in 1880 after a spell with the Birmingham Cricket and Football Club. He was only 21 when he represented England in international matches against Scotland, Wales and Ireland. He was a member of the Villa team which won the English F.A. Cup for the first time in 1887. He retired from football at the close of that season and turned his attention to hockey, speedily graduating as a county player. Mr. Vaughton often played for the Staffordshire County Cricket Club, and playing against the Australians in 1880, caught the famous W. L. Murdoch. He served on the Management Committee and the Ground Committee of the Warwickshire County Cricket Club. He showed similar proficiency at skating, and before he was 16 years of age had won the first prize in the All-England rink figure-skating contest.

Mr. Vaughton was a widower. The funeral will be at Yardley Wood Church on Monday.

FUNERAL OF MR. HOWARD VAUGHTON

Midland sportsmen were among the mourners at the funeral of Mr. Oliver Howard Vaughton, former president of Aston Villa Football Club, which took place at Yardley Wood Church yesterday.

The service was conducted by the Rev. I. Rees-Jones, while Mr. H. A. Elliott was at the organ.

Mr. Oliver Howard Vaughton, of 23, Oxford-road, Moseley, former player and president of the Aston Villa F.C., left £5,969, net personalty £5,572.
Probate has been granted to his son, Howard George Vaughton, of Edgbaston-road, Birmingham, company director, and his daughter, Miss Annie Reeve Smith Vaughton, of 23, Oxford-road, two of the persons entitled to share in the estate, his wife, to whom he left all his property, having pre-deceased him.

Special Resolution of the ELITE BRACELET MANUFACTURING CO. Ltd. Passed 24th November, 1930.
At an Extraordinary General Meeting of the Members of the above Company, duly convened, and held at the Regent Works, Upper Regent-street, Birmingham, on Monday, 24th November, 1930, the following Special Resolution was duly passed: —
Resolution.
" That the Articles of the Company be amended so as to include the following immediately after Article No. 18.
" 18. (a) The Company in General Meeting may by Resolution direct the capitalization of any undivided profits of the Company, whether standing to the credit of a reserve fund or not, and whether the same shall be in the nature of income or of ascertained accretions to capital, and the Directors shall give effect to such Resolutions by applying the profits to be so capitalized in paying up either (a) partly paid shares held by Shareholders who would be entitled to such profits it the same were distributed by way of dividend or (b) unissued shares of the Company to be thereupon issued to such Shareholders as aforesaid or (so far as such issue shall be impracticable in consequence of the fractions involved) to be sold for the benefit of the Shareholders entitled thereto or dealt with by the issue of fractional certificates or otherwise at the discretion of the Directors.

Notice is hereby given, that at an Ertraordinary General Meeting of the Shareholders of the said Company, duly convened and held at the registered office of the Company, Ryland-street, Birmingham, on the 20th day of April, 1886, the following Special Resolutions were passed:—

1. "That the provisional agreement, dated the 10th December, 1885, for the sale of the Company's business and property to Messrs. Gilbert
and Spurrier Limited, be and is hereby approved.
2. " That John Gilbert and Company Limited be wound up voluntarily.
3. " That the Liquidator or Liquidators to be appointed on the confirmation of the last-mentioned resolution be authorized to carry into effect
the terms of the said provisional agreement, and to do all acts necessary for that purpose.

" That the Liquidators be authorized to carry into effect the agreement, dated the 11th day of December, 1885, made between William Spurrier Limited of the first part, William Spurrier of the second part, the several persons signatories to the first schedule to the said agreement of the third part, the several persons signatories to the second schedule to the said agreement of the fourth part, and Gilbert and Spurrier Limited of the fifth part, and to make such arrangements or modifications, and do such things as they may think necessary, for carrying out the substantial terms thereof."

GOODE & BOLAND

Newark, N. J., Feb. 8. — The sudden death on Feb. 1st, from apoplexy, of Frederick Long, removes one of the best known gold chain makers in this city. He was born in London about 65 years ago, but in early life went to Birmingham, where he was employed by the old firm of Goode & Boland, St. Paul’s Square. Subsequently, because of the depression in the jewelry business in England, he turned his attention to rifling gun barrels for the Crimean War, and afterwards for the American trade. He came to this country about 1865 and was at once employed by the old firm of Carter, Hale & Co., and remained in the employ of this firm and their successors until his death.

Mr. Long was an expert mechanic as well as a true and honorable man, and for many years superintended the department in the factory in which the very fine chains and the old fashioned loop bracelets were made, having charge of about 125 girls. He had old fashioned ideas of loyalty to his employers as well as of fairness to his associates and those of whom he had charge, and thus won and held the respect and esteem of all with whom he was associated. He was a man of pure life and of domestic tastes, a good husband and a kind father. He leaves a widow, two sons and two daughters.

The funeral occurred Monday afternoon, when the department in the factory with which he was connected, closed as a token of respect to his memory. His fellow employes attended the funeral in a body.
