STEPHEN SMITH (Thomas Smith & Sons)
Edinburgh
ROYAL CUSTOMERS
BANKRUPT JEWELLER REFUSES TO DISCLOSE TRANSACTIONS
Stephen Smith, goldsmith and jeweller, of Edinburgh, who carried on one of the principal businesses of its kind in the Scottish capital, examined in bankruptcy, put his liabilities at £59,000, and the assets at £31,000. The bankrupt explained that he had sold great quantities of stock in auction rooms at a heavy loss, and had pawned several thousand pounds' worth, which he had not been able to redeem. An accountant, representing creditors, asked concerning some proposed transaction with the Royal Family concerning the royal wedding. Mr. Smith refused to answer the question, saying that during his fourteen years' dealings with royalty he had been repeatedly warned against making public these transactions. The Sheriff was asked for an order to answer, and eventually the information was disclosed privately.

PETER FORRESTER AND COMPANY
Edinburgh
Peter Forrester and Company - Edinburgh - 1793
EXCLUSIVE PRIVILEGE
No. 128.
Andrew M'lean V. Hammermen of Edinburgh. June 26, 1793
Exclusive Privilege.—A free craftsman cannot, by contract, communicate a share of the craftman's profit to a merchant or guild-brother who employs him.
Peter Forrester was a brother of the Merchant Guild of Edinburgh, and kept a hardware shop there, in which he dealt, inter alia, in selling watches on commission. To keep his watches in good condition, he, on the 18th of November, 1789, entered into a contract for a twelvemonth, with Andrew M'Lean, an old soldier, and a King's freeman, wherein M'Lean engaged to clean and repair watches for him, at a certain rate per week: M'Lean was to perform this service, in a part of Forrester's premises, adjoining to his shop.
The Corporation of Hammermen complained of this contract as an infringement of their privileges. If M'Lean were to be considered as a journeyman, engaged by Forrester, and receiving wages as such, Forrester was thus drawing the profit of master craftsman; which he had no right to do, being a guild brother only, and no craftsman. If, on the other hand, as the terms of the agreement seemed to indicate, the craftsman's profit was to be shared between the two, then M'Lean did wrong in packing and peeling with Forrester, an unfreeman, and thus communicating to him the benefit of his own privilege as a free craftsman.
The case came into Court by a suspension, at the instance of M'Lean, which was conjoined with an action of damages, at the Corporation's instance, against him and Forrester.
The Lord Ordinary (Abercromby), "Found that the said Andrew M'Lean is entitled to the privilege conferred by statute on officers, mariners, soldiers, and marines; but, Finds, that the said Andrew M'Lean is not entitled to communicate that privilege to the defender, Peter Forrester, an unfreeman, in the manner attempted to be done by the agreement betwixt the said Andrew M'Lean and Peter Forrester, of date the 18th November, 1790, narrated in the libel; and in respect thereof, Finds and declares that the said Andrew M'Lean has no right or title to carry on or practise the watchmaker or clockmaker business, in any of its branches, in the shop of the said Peter Forrester, or Peter Forrester and Company, or in any house or shop within the liberties of the city of Edinburgh, for behoof of the said Peter Forrester, or Peter Forrester and Company, in terms of the said agreement; and, therefore, prohibits and discharges the said Peter Forrester, or Peter Forrester and Company, from allowing or employing the said Andrew M'Lean to work at the clock and watchmaking business for them, or for their behoof, either in their said shop and house, or in any other shop or house within the city of Edinburgh, or liberties thereof, in virtue of the said agreement: Finds the defenders liable in damages and expenses, and appoints an account thereof to be given in."
Two successive petitions, reclaiming against this interlocutor, were refused, without answers (20th June, and 9th July, 1793.)
For M'Lean, John Patison.
